Late bid by Masimo, Sound United to remove another Apple patent from US trial fails

The holding clears a path for Apple to assert nine design and utility patents at a planned Oct. 21 trial, which will also cover antitrust counterclaims by Masimo and Sound United. A pretrial conference is scheduled for tomorrow.Claims by Masimo and Sound United that an Apple patent runs afoul of Section 101 of the Patent Act have been rejected as both procedurally improper and deficient on the merits....
