Slovenia should lose appeal of annulled Lekarna Ljubljana probe closure, legal opinion says

( April 18, 2024, 08:57 GMT | Official Statement) -- MLex Summary: Slovenia should lose its legal challenge of an earlier court ruling that annulled the European Commission's closure of an investigation into public support to pharmacy chain Lekarna Ljubljana, according to a legal opinion for the EU's top court released today. In 2022, the lower court found that the commission faced difficulties in its initial review, and that it should have started a full probe into the support. In his non-binding opinion delivered today, Advocate General Athanasios Rantos recommended that the top court dismiss the appeal as unfounded. He said it seemed reasonable to conclude that “those uncertainties should objectively have given rise to doubts as to the classification of the aid as existing aid, leading to the initiation of the formal investigation procedure.”The Advocate General Opinion is attached.
