National court can estimate amount of aid to be recovered if EU commission doesn’t make binding specifications, EU court rules

( February 13, 2014, 09:59 GMT | Official Statement) -- MLex Summary: The EU’s Court of Justice has ruled that national courts tasked with recovering illegal aid are not bound by estimates by the European Commission on how much aid should be clawed back from recipients, unless those calculations are set out in a binding decision. But the national court must take such statements into consideration, the EU court said. If the commission hasn’t specified the precise amount to be repaid, nor the parties from which it should be recovered, then the national court may decide the amount due is zero, if that is what its own calculations yield. The case concerns a dispute between the Italian ministry of economic development and broadcaster Mediaset, over the recovery of illegal aid for digital TV decoders.Read the full judgment below....
