Demographic criteria applied in Austria in relation to the opening of new pharmacies are incompatible with the freedom of establishment, EU court says

( February 13, 2014, 09:12 GMT | Official Statement) -- MLex Summary: The EU's highest court has today clarified that national laws setting rigid population thresholds for the launch of pharmacies are incompatible with the freedom of establishment, following a request for a preliminary ruling from an administrative court in Austria. Applying strict criteria such as requiring a number of over 5,500 inhabitants for the set-up of a new pharmacy may not ensure "equal and adequate access [...] for certain people living in rural and isolated regions outside the existing pharmacies", the court found.Full statement in case C-367/12  Sokoll-Seebacher follows.
