Administrative judge applied wrong standard in LabMD case, FTC says in order reversing dismissal

( July 29, 2016, 15:21 GMT | Official Statement) -- MLex Summary: The Federal Trade Commission's administrative law judge applied the wrong legal standard when he dismissed the FTC's data security complaint against medical testing company LabMD, the commission said in a unanimous decision reversing that ruling. Writing for the commission, Chairwoman Edith Ramirez said "LabMD’s security practices were unreasonable, lacking even basic precautions to protect the sensitive consumer information maintained on its computer system," and LabMD should "notify affected consumers, establish a comprehensive information security program reasonably designed to protect the security and confidentiality of the personal consumer information in its possession, and obtain independent assessments regarding its implementation of the program."See document below....
