Judge trims state claims from Lidoderm pay-for-delay suit

Orrick partially granted a motion by Endo Pharmaceuticals, Teikoku Seiyaku, and Watson Pharmaceuticals to dismiss certain state claims in a case accusing them of unlawfully delaying the market entry of generic Lidoderm. Orrick agreed to dismiss consumer protection claims from end-payor plaintiffs Utah and Massachusetts. Orrick also dismissed the Government Employees Health Organization’s Rhode Island antitrust claim, consumer protection claims in 14 states and unjust enrichment claims in 28 states. See document below. ...
