Photographer loses legal dispute over use of photo for AI training, Hamburg Court rules

( September 27, 2024, 16:20 GMT | Official Statement) -- MLex Summary: A photographer's complaint against the use one of his photographs for AI training purposes has been dismissed by the Hamburg Regional Court. The downloading of the image as part of the creation of a dataset is covered by a limitation provision of the German Copyright Act if the text and data mining is carried out for scientific research purposes. As the action was dismissed on this ground, the court declared that it didn't have to rule on how the possible subsequent use of the image to train generative artificial intelligence should be legally assessed. The case was brought by the German photographer Robert Kneschke against the image database creator Laion.
