Subscribers opposes motion to dismiss claims of illegal geographic allocation by BCBS

( January 15, 2014, 23:31 GMT | Official Statement) -- MLex Summary: Subscriber plaintiffs have filed an opposition to Blue Cross Blue Shield defendants’ motion to dismiss claims that it conspired to engage in geographic allocation. Plaintiffs argue that even though the defendants filed their premium rates with insurance regulators they are not immune from antitrust liability because the US Supreme Court has never applied the filed rate doctrine to bar antitrust actions based on a state filed rate.  See document below....
