Amazon seeks dismissal of California attorney general's antitrust lawsuit over restrictions on sellers

( December 7, 2022, 22:32 GMT | Official Statement) -- MLex Summary: Amazon says an antitrust complaint filed by California's attorney general accusing the company of placing illegal restrictions on merchants to prevent them from selling products at lower prices elsewhere fails as a matter of law, in documents filed at state court in San Francisco. In its response to the claims, Amazon says it would have had to act in concert with others to restrain trade to break California's Cartwright Act, and that the lack of any explicit agreement means the lawsuit fails on those grounds alone. The AG also fails to show substantially adverse effects arising from its 'guaranteed minimum margin' agreements and a price parity clause that Amazon removed in 2019, the company says. Amazon asserts third-party sellers determine the prices they offer on other online stores, and that "courts have described price parity provisions as a common and procompetitive way for businesses to obtain lower prices."Court document attached....
