Amazon not liable for foreign damages after US judge says scienter requirement applies to Patent Act Section 271(f)

In an opinion unsealed last week, the court found “no persuasive reason” why the US Supreme Court’s articulation of the scienter requirement of Section 271(b) of the Patent Act would not also apply to Section 271(f)(1) and 271(f)(2) of the Patent Act. Both the plaintiff and defendant argued against the application of GlobalTech Appliances v. SEB to their case.Amazon has won a summary judgment that a patent owner can't seek damages for infringement which may have occurred abroad....
