Tech companies urge US Supreme Court to side with TransUnion in 'no injury' class action case

( February 8, 2021, 21:00 GMT | Official Statement) -- MLex Summary: A slew of tech companies and associations say the US Supreme Court should reverse a case upheld by the US Court of Appeals for the Ninth Circuit granting damages to a class of individuals whom credit reporting agency TransUnion wrongly linked with terrorism. TransUnion says the high court should overturn the case since plaintiffs suffered no actual harm. eBay, Google, Facebook and allied industry associations say the same. Tech companies are often defendants in class actions brought under statutes that provide private rights of action. "If left intact, the Ninth Circuit’s opinion in this case would ... open the floodgates for abusive litigation that redresses no injury and benefits no consumer," the companies wrote.
