Yorkshire Purchasing, Findel say CMA fails to grasp reality of market in merger probe

( August 19, 2020, 11:40 GMT | Official Statement) -- MLex Summary: Yorkshire Purchasing Organisation and Findel Education have said they fundamentally disagree with the market characteristics set out by the UK Competition and Markets Authority in its phase I probe of their deal, which combines a public-sector procurement consortium with a provider of school supplies. In a response to the CMA's statement covering the scope of the phase II probe, the companies said they operate in a fragmented marketplace where they compete not only against strong generalists such as Amazon and Herts, but also against retailers such as Ryman, Argos and Tesco, as well as about 100 manufacturers that supply customers directly. "All these suppliers target the same customers, to meet their various demands. Ignoring these competitors, both in considering the product frame of reference and in assessing the competitive dynamics of this market has led to the CMA failing to reflect the reality of this market," YPO and Findel said in a joint response statement published today.The response is attached....
