Vyera loses bid to dismiss FTC, states' federal antitrust claims, but gets Pennsylvania law claim thrown out

( August 18, 2020, 19:42 GMT | Official Statement) -- MLex Summary: Vyera Pharmaceuticals must face monopolization claims brought by the US Federal Trade Commission and several state attorneys general offices, US District Judge Denise Cote said in a ruling denying the company's motion to dismiss claims under the Sherman Act and FTC Act. However, Cote did dismiss claims under Pennsylvania's Unfair Trade Practices and Consumer Protection law because the plaintiffs failed to identify fraudulent behavior by Vyera and the law fails to expressly identify monopolistic behavior, according to the ruling.See document below....
