Clearview AI must face Illinois privacy claims, judge rules

( August 12, 2020, 21:47 GMT | Official Statement) -- MLex Summary: A federal judge in Chicago denied facial recognition company Clearview AI's motion to dismiss allegations that it violated the Illinois Biometric Information Privacy Act (BIPA) by scanning the faces of millions of Americans and marketing that facial recognition data. US District Judge Sharon Johnson Coleman called arguments by the company and its leadership — Hoan Ton-That and Richard Schwartz — that Clearview is not subject to BIPA because it has no physical presence in Illinois "untenable" and "without merit." The judge also rejected as "perfunctory, undeveloped and thus waived" the argument by Ton-That and Schwartz that they are not subject to personal jurisdiction for BIPA violations. Finally, the judge denied a motion to transfer the case to New York City, where Clearview is based.See attached order....
