California labor unions urge US appeals court to limit issues in rehearing of privacy case against ZoomInfo

( February 8, 2024, 22:31 GMT | Official Statement) -- MLex Summary: A US appeals court rehearing of a case brought by a union organizer against ZoomInfo should not involve the applicability in federal court of the core protections provided by California’s anti-strategic lawsuits against public participation statute, according to a group of California labor unions. The organizations filed a brief in support of neither party with the US Court of Appeals for the Ninth Circuit in a case over ZoomInfo collecting and publishing personal data. “Plaintiff-Appellee Kim Martinez (Martinez) did not challenge applicability below, either in the district court or to the panel, and she has therefore waived the applicability issue. Nor is the applicability issue otherwise properly before the en banc court now, as it is neither jurisdictional nor necessarily embedded in the threshold collateral-order issue,” they argued.See document below. ...
