Continental Automotive looks for full panel rehearing in appeal of US antitrust case against Avanci

( April 13, 2022, 22:31 GMT | Official Statement) -- MLex Summary: Continental Automotive Systems said a Fifth Circuit panel decision against its US antitrust claims against Avanci and holders of standard-essential patents over a connected cars licensing dispute requires a full rehearing. It petitioned the appeals court, arguing the Ninth Circuit and the Federal Circuit have recognized that any business that implements the standards and seeks a license with an SEP is a third-party beneficiary of the patent holder’s Frand promise and can enforce that promise. In addition, Continental Automotive argued the panel’s holding disregards Supreme Court precedent on standing and the obligation to accept the well-pleaded allegations in a complaint.See document below. ...
