Court of Justice: Report for the Hearing in C-446/09 Koninklijke Philips Electronics v Lucheng Meijing Industrial Company, Other

( November 18, 2010, 10:44 GMT | Official Statement) -- MLex Summary: The ECJ is hearing today a case on whether a regulation dealing with measures prohibiting the release of seized counterfeit and pirated goods allows for an assumption, 'legal fiction' that pirated goods in transit are to be deemed as manufactured in the country of confiscation, and not as seized in transit. The ECJ's ruling will determine whether Philips must demonstrate before the national court that razors shipped from China will be traded illegally in Belgium, in order to obtain conservable measures.Read the Dutch language version of the full report below....
