Amex wins partial summary judgment in anti-steering case

( January 14, 2019, 22:31 GMT | Official Statement) -- MLex Summary: US District Judge Nicholas G. Garaufis has granted American Express’ motion for summary judgment against merchant plaintiffs’ one-sided market allegations and their allegations of an Amex-only market in a case over the company’s anti-steering rules. Garaufis determined that a previous case brought by the US government already determined that credit-card networks are two-sided platforms. Garaufis rejected plaintiffs’ Amex-only market allegations, finding that Amex’s alleged pre-contract power comes from “cardholder insistence,” which cannot form the basis for market power.See document below....
