( July 31, 2023, 22:31 GMT | Official Statement) -- MLex Summary: NetChoice and Chamber of Progress told the US Appeals Court for the Ninth Circuit that it should dismiss claims seeking to hold Google, Meta and Apple liable for gambling apps on their app stores. They said that Section 230 of the Communications Decency Act protects interactive computer services like online app stores from liability based on information provided by third parties. “Plaintiffs’ theory of liability would require the Services to monitor all third-party content, which several courts have held is subject to Section 230,” they argued. They also said, “Permitting a payment-processor loophole in Section 230 would thwart Congress’s goal of promoting a vibrant, innovative Internet and e-commerce ecosystem.”See document below. ...
