Personal-data theft can result in claiming compensation for non-material damages, EU court opinion says

( October 26, 2023, 09:05 GMT | Official Statement) -- MLex Summary: The theft of personal sensitive data may give rise to a right to compensation for non-material damage, a legal opinion prepared for the EU's top court suggested today. In his non-binding opinion, Advocate General Michael Collins said that in such case, the right to non-material damages for infringements of the EU's GDPR must be proved, as well as the actual damage suffered, and there should be a causal link between the damage and that infringement. Collins also said that the award of such compensation doesn't require the thief to have to impersonate the target, and that merely having information that can identify the person doesn't count as identity theft. The opinion was made as part of a dispute referred from Germany over the right to compensation for non-material damage under the GDPR....
