Court of Appeal: Judgment in A3/2008/0080 Devenish Nutrition v Sanofi-Aventis

( October 15, 2008, 10:09 GMT | Official Statement) -- ****************************************MLex Summary: The Court of Appeal in London has dismissed an appeal brought by Devenish, a group of poultry farmers, against vitamins manufacturers including BASF and Roche, seeking to regain damages from the companies found guilty of cartel activity by the European Commission. The court ruled that "Devenish is entitled to be compensated for any loss it has suffered as a result of the cartel, no more and no less", thus going against the prospect of triple damages in private claims. Devenish was unable to prove its financial loss but maintained it should receive a slice of the cartel's illegal profits....
