US DOJ, states say consumer preference for Google's search engine doesn't shield its conduct from antitrust liability

( August 1, 2023, 23:00 GMT | Official Statement) -- MLex Summary: The US Department of Justice and a multistate group suing Google for alleged search monopolization moved a federal court to preclude Google from introducing evidence at trial that the quality of its products insulate the tech giant from a finding of liability. In an "in limine" motion, they also said that the court should preclude the search platform from presenting evidence that actions it took to improve its products can't support a monopoly maintenance claim under Section 2 of the Sherman Act. Google has argued that its conduct cannot support a monopoly maintenance claim under Section 2 so long as it makes Google’s products more attractive to consumers. "[W]hile Google may argue that consumers prefer its general search engine, under the law Google cannot argue that any such preferences shield its conduct from antitrust liability," the filing said....
