Plaintiffs suing Gilead over HIV drugs file reply for restarting US antitrust case

( July 17, 2025, 22:31 GMT | Official Statement) -- MLex Summary: Gilead’s efforts to switch patients to Tenofovir alafenamide-based drugs – even if based on misrepresentations about drug safety – are not immune to liability just because the company never withdrew Tenofovir disoproxil-based drugs from the market, plaintiffs told a US appeals court. “Even if the older product remained on pharmacy shelves, Gilead’s tactics deprived patients, prescribers, and insurers of the meaningful ability to choose generic TDF. And the district court acknowledged that Plaintiffs presented evidence that Gilead unlawfully delayed generic entry through agreements with competitors and a pay-for-delay settlement,” they argued in favor of overturning an ordering that dismissed their antitrust claims against Gilead.See attached file. ...
