FIFA rules must be open to Belgian court review, EU court opinion says

By Lewis Crofts ( January 16, 2025, 09:24 GMT | Insight) -- Rulings by the Court of Arbitration for Sport in Switzerland should be open to review by national judges within the EU to ensure the bloc’s laws — such as provisions on fair competition — are respected, according to a legal opinion for the EU’s Court of Justice. Advocate General Tamara Ćapeta said judges inside the EU needed to be able to ensure the compatibility of FIFA rules with EU law, and therefore national laws couldn’t limit their judges from reviewing arbitral awards. Rulings by the Court of Arbitration for Sport in Switzerland should be open to review by national judges within the EU to ensure the bloc’s laws — such as provisions on fair competition — are respected, according to a legal opinion for the EU’s Court of Justice....
