Swiss sports arbitration court decisions must be reviewable by EU judges, adviser says

( January 16, 2025, 09:55 GMT | Official Statement) -- MLex Summary: Rulings by Switzerland's Court of Arbitration for Sport must be able to face a “full review” by national courts in EU member states, according to a legal opinion prepared for the bloc’s top court. Today's guidance stems from a referral made by a Belgian court, in a dispute between football club RFC Seraing and national, European and global football governing bodies. Seraing was sanctioned in 2015 for breaching FIFA rules banning companies other than clubs from owning players, and saw an appeal at the CAS rejected. Today, Advocate General Tamara Ćapeta said that “direct access to and full judicial review” by a national court must be available to sports clubs, “a final CAS award notwithstanding.”Press release follows.
