US DOJ, FTC submit statement on interlocking directorates in Musk-OpenAI case

( January 10, 2025, 20:20 GMT | Official Statement) -- MLex Summary: The US Department of Justice and Federal Trade Commission submitted a statement of interest in Elon Musk's legal dispute with OpenAI and its chief executive, Sam Altman. The agencies said they were filing the statement in response to Musk's motion for a preliminary injunction, "to address the proper standards for analyzing whether" a claim under Section 8 of the Clayton Act, which prohibits interlocking directorates, is moot and whether "a company violates Section 8 by appointing a natural person to serve on the board of a competing company." The agencies also said their statement "explains how interlocking board member arrangements can undermine fair competition and therefore violate the FTC Act and, by extension, California’s" Unfair Competition Law....
